Welcome to Pelevo, a podcast listening and rewards platform operated by Pod Emeralds Limited (“we,” “us,” “our”). These Terms & Conditions of Service (“Terms”) govern your use of our application, services, and features available through the Pelevo mobile and web platforms (collectively, the “App”).

By downloading, accessing, or using the Pelevo App, you (“you,” “user”) agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the App.

1. Eligibility

• Be at least 13 years old.
• Agree to and abide by these Terms.
• Reside in a country where our services, including the rewards system, are legally permitted.

Note: The earning and withdrawal features are currently only available to users located in the United States.

1.1. User Accounts

• Maintaining the security of your account and password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring you are at least 13 years old to use the service

2. Service Overview

• Access to a curated library of podcasts
• Listen to curated and monetized podcasts.
• Earn virtual rewards in the form of Pelevo Coins based on their listening activities.
• Withdraw eligible coins as cash once a specified withdrawal threshold is reached.

Podcasts available in the app may be:

• Created by independent hosts.
• Scripted and voiced using AI technology.
• Sponsored and monetized, enabling revenue sharing between Pod Emeralds Limited and eligible users.

3. Earning Rewards

• Listening to monetized podcasts made available within the app.
• Complying with listening engagement rules (e.g., minimum listen time, skipping restrictions).

The rate of earning coins may vary based on:

• The specific podcast,
• Current sponsorship agreements,
• Listening behavior or engagement metrics.

We do not guarantee earnings, and we reserve the right to change reward structures at any time without prior notice.

4. Withdrawals

• Coins earned can be converted into cash and withdrawn once the minimum withdrawal threshold is met.
• The withdrawal feature is only available to users located in the United States.
• All withdrawals are subject to review and verification, and may take several business days to process.
• We reserve the right to deny withdrawal requests in cases of suspected fraud, terms violations, or if a podcast host cancels sponsorship or revenue-sharing arrangements.

5. Monetized Podcasts and Sponsorship

• Some of the podcasts on Pelevo are monetized, meaning they generate revenue through sponsorship, ads, or other monetization strategies.
• We share a portion of the revenue from these podcasts with eligible users who meet listening criteria.
• If a podcast sponsor cancels or terminates their sponsorship, we reserve the right to discontinue or withhold payout associated with those podcasts, even if you have already engaged with the content.

6. Account Suspension & Termination

• Violated any provision of these Terms.
• Engaged in fraudulent, automated, or deceptive behavior.
• Attempted to exploit or abuse the rewards system.
• Used the app in any way that interferes with its normal operation or violates applicable laws.

Decisions to suspend or withhold earnings are made at our sole discretion and are not subject to appeal.

7. Ownership & Intellectual Property

All content on the App, including AI-generated scripts, audio content, branding, graphics, and code, is the exclusive property of Pod Emeralds Limited or its licensors and content partners. Podcast content available through our service is owned by their respective creators and is subject to their own terms and conditions.

• Copy, reproduce, redistribute, or sell any content.
• Use the app's materials for any commercial or unauthorized purpose.

8. User Conduct

• Use the app lawfully and respectfully.
• Not impersonate others or misrepresent your identity.
• Not interfere with the app's technical integrity or security.
• Refrain from using bots, automated scripts, or other means to artificially inflate listening or earning activity.

9. Disclaimers

• Pelevo is provided "as is" and "as available." We do not guarantee uninterrupted service or that the app will be free from bugs or inaccuracies.
• Rewards are provided based on available sponsorships and revenue. We make no guarantees of future earnings or payment schedules.
• We reserve the right to modify or discontinue any part of the app, including the rewards program, at any time and without prior notice.

10. Limitation of Liability

To the maximum extent permitted by law, Pod Emeralds Limited, nor its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app, rewards, or podcasts.

11. Privacy Policy

Your use of Pelevo is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted in the app or on our website. Continued use of Pelevo after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pod Emeralds Limited is registered, without regard to its conflict of law principles.
